Please read these Terms of Service ("Terms") carefully before downloading, installing, or using the Swing Trade Signals mobile application ("App", "Service", "we", "us", "our"). By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, do not use the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into a binding agreement;
• You have read and understood these Terms in full;
• You agree to comply with all applicable laws and regulations in your jurisdiction;
• Your use of the App will not violate any applicable law or regulation.

If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

Swing Trade Signals is a technical analysis application that uses proprietary automated algorithms to scan publicly available stock market data and generate informational signals for US-listed equities and exchange-traded funds (ETFs). The App provides:

• Algorithmic signal classifications (BUY, HOLD, SELL) based on technical analysis of historical price, volume, and market data;
• Suggested reference levels (entry zone, price targets, stop-loss reference points) derived from technical analysis — not guaranteed exit levels;
• Market overview data including sentiment indicators, sector analysis, and financial news aggregated from publicly available sources;
• A personal watchlist feature for monitoring stocks of interest;
• Optional push notifications alerting you to newly generated signals.

The App is not a broker-dealer, investment adviser, or financial planner. It does not execute trades, manage portfolios, or hold any securities on your behalf.

3. Algorithm and Methodology

The signals generated by the App are produced by proprietary automated algorithms that analyse technical characteristics of historical market data. You acknowledge and agree that:

• The specific indicators, weightings, scoring methods, thresholds, and logic used by the algorithms are proprietary and confidential, and are not disclosed to users;
• The methodology, algorithms, and signal logic may be modified, updated, improved, or discontinued at any time without prior notice to users;
• Algorithm updates may change the frequency, nature, or characteristics of signals generated, and past signal behaviour is not predictive of future algorithm behaviour;
• Automated signals may contain errors, omissions, or inaccuracies, and no signal should be treated as a definitive recommendation to act;
• The algorithms operate on historical and delayed data and cannot account for breaking news, earnings surprises, regulatory changes, macroeconomic events, or other information not reflected in historical price and volume data.

4. Financial Disclaimer — Please Read Carefully

Swing Trade Signals and its developers are not registered investment advisers, broker-dealers, financial planners, or financial analysts. The App and its developers are not registered with the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any other financial regulatory body in any jurisdiction.

All signals, classifications, reference levels, analysis, and information provided through the App are generated by automated technical analysis algorithms and are provided solely for educational and informational purposes. They do not constitute:

• Financial, investment, or trading advice of any kind;
• A recommendation to buy, sell, or hold any security;
• A solicitation or offer to buy or sell any security;
• A guarantee or representation of future performance or profitability;
• An assurance that any signal will achieve its suggested reference levels.

Past performance of any signal, algorithm output, or indicator does not guarantee future results. Trading and investing in securities involves substantial risk, including the possible loss of your entire invested capital. You should only trade or invest with money you can afford to lose entirely.

Reference levels shown in the App (including entry zones, price targets, and stop-loss references) are mathematically derived from technical analysis and are provided as starting points for your own research only. They are not guaranteed exit points and actual market prices may gap through, skip over, or never reach these levels.

Before making any investment or trading decision, you should:

• Conduct your own independent research and due diligence;
• Consult with a licensed financial adviser, broker, or investment professional;
• Consider your own financial situation, investment objectives, experience level, and risk tolerance;
• Understand that no algorithmic system, regardless of complexity, can reliably predict future market movements.

You acknowledge and agree that Swing Trade Signals, its developers, officers, employees, and affiliates bear no responsibility or liability whatsoever for any trading or investment decisions you make based on information provided by this App, regardless of outcome.

5. No Performance Guarantee

We make no representation, warranty, or guarantee, express or implied, regarding:

• The accuracy, completeness, or timeliness of any signal or data;
• The profitability or success rate of any signal or group of signals;
• The App's suitability for any particular trading strategy or objective;
• Uninterrupted availability of the App or its data feeds.

Any historical signal performance data, win rates, average returns, or statistical metrics that may be referenced in marketing or promotional materials are based on backtested or historical analysis and do not predict future performance. Backtested results are inherently limited and subject to hindsight bias, overfitting, and market condition changes.

6. Data and Information Accuracy

Market data is sourced from third-party data providers and is subject to errors, delays, interruptions, and inaccuracies beyond our control. We do not warrant the accuracy, completeness, or fitness for purpose of any data displayed in the App. All prices and signals reflect a minimum 15-minute delay from real-time market data.

7. User Responsibilities

By using the App, you agree to:

• Use the App only for lawful purposes and in compliance with these Terms;
• Not attempt to reverse-engineer, decompile, disassemble, or extract the App's algorithms, signal logic, scoring methodology, or source code;
• Not use the App to engage in any form of market manipulation, insider trading, or illegal trading activity;
• Not redistribute, resell, republish, or commercially exploit the App's signals, data, or content without prior written consent;
• Not use automated tools, bots, or scripts to access or scrape the App's data or API;
• Accept sole and complete responsibility for any trading or investment decisions you make;
• Provide accurate information when registering for push notifications;
• Maintain the security of your device and prevent unauthorised access to the App.

8. Intellectual Property

The App, including its signal algorithms, scoring methodology, user interface, design, branding, and all content, is owned by Swing Trade Signals and protected by applicable intellectual property laws including copyright, trade secret, and patent law. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.

Market data, stock prices, and financial information displayed in the App are sourced from third-party data providers and remain the property of their respective owners. The App's signal outputs and analysis are original works and may not be reproduced, distributed, or used commercially without permission.

9. Third-Party Services

The App integrates with the following third-party services, each subject to their own terms and privacy policies:

• Google AdMob — advertising services. Google Advertising Policies.
• Firebase / Firestore — data storage and infrastructure. Firebase Terms of Service.
• Expo Push Notifications — signal alert delivery. Expo Terms of Service.
• Third-party market data providers — publicly available stock market data. Subject to respective provider terms.

We are not responsible for the practices, availability, accuracy, content, or policies of any third-party service. Changes to third-party services may affect App functionality without notice.

10. Advertising

The App displays advertisements served by Google AdMob. We have no control over the specific content of advertisements displayed. Advertisements are not endorsements of any product, service, or security by Swing Trade Signals.

The App does not accept payment from any company, individual, or organisation to promote, feature, or favour any security, ETF, or financial product within its signals, analysis, or content. Signal generation is fully automated and cannot be influenced by commercial relationships.

11. Push Notifications

If you grant notification permission, the App may send push notifications when new signals are generated. You can disable notifications at any time in your device settings. We do not guarantee the delivery, timeliness, accuracy, or completeness of push notifications. Push notification content is automatically generated and does not constitute personalised financial advice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Swing Trade Signals, its developers, officers, employees, agents, and affiliates shall not be liable for any damages of any kind arising from your use of or reliance on the App, including but not limited to:

• Financial losses of any amount arising from trading or investment decisions;
• Loss of profits, revenue, capital, data, or business opportunity;
• Errors, inaccuracies, omissions, or delays in signals or market data;
• Interruptions to App availability, functionality, or data feeds;
• Third-party service failures, outages, or policy changes;
• Any reliance on signal reference levels that are not reached in practice;
• Algorithm changes that affect signal characteristics or frequency.

In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, our liability is limited to the maximum extent permitted by law. In no event shall our total aggregate liability exceed the amount you paid to use the App in the twelve months preceding the claim (which, as the App is free, shall be zero).

Your use of this App is entirely at your own risk.

13. Indemnification

You agree to indemnify, defend, and hold harmless Swing Trade Signals and its developers, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or access to the App;
• Your violation of these Terms;
• Your violation of any third-party rights;
• Any trading or investment decisions made based on App content;
• Your violation of any applicable law or regulation.

14. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or the App shall be resolved through binding individual arbitration rather than court proceedings, to the extent permitted by applicable law. You waive any right to participate in class action lawsuits or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property rights.

15. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Material changes will be indicated by updating the "Last updated" date above. Continued use of the App after any changes constitutes acceptance of the revised Terms. If you do not agree with revised Terms, you must discontinue use of the App.

16. Termination

We reserve the right to suspend, restrict, or terminate your access to the App at any time, without prior notice, for any reason including but not limited to violation of these Terms, suspected illegal activity, or extended periods of inactivity. Upon termination, all licences granted to you under these Terms cease immediately.

17. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes that proceed to court shall be resolved in the courts of competent jurisdiction in the developer's place of residence, and you consent to personal jurisdiction in such courts.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Swing Trade Signals regarding your use of the App and supersede all prior agreements, understandings, and representations.
